These terms apply to this website and to the Driver Training, Operator Training and Compliance Dashboard apps (the "service"). Integrated Driver Solutions and Integrated Operator Solutions are operated by Rick Rossiter, a sole trader based in Western Australia. In these terms "we", "us" and "our" mean that business, and "you" means the organisation using the service and the people it gives accounts to.
1. The service
The service provides training programs, VOC (Verification of Competency) forms, record keeping and compliance reporting for drivers and plant operators. It is a tool to help your organisation run and record its own training and assessment. It does not issue licences, nationally recognised qualifications or statements of attainment, and we are not a Registered Training Organisation.
2. Founding Pilot
- The Founding Pilot runs for 8 weeks and is free. There is no payment, card or obligation to buy.
- In return, we ask for a nominated contact, real VOCs completed in the app, two short surveys and one feedback call.
- Places and user numbers are limited, as described on the Founding Pilot page.
- Because the service is still being refined, features may change during the pilot.
- At the end of the pilot you can continue under a separate agreement or stop. If you stop, we will export your records on request and then delete or de-identify them as set out in the Privacy Policy.
Any paid service will be covered by a separate written agreement, which will take priority over these terms where they differ.
3. Accounts
- Accounts are created by invitation for your organisation's managers, trainers, assessors and compliance staff.
- Keep passwords private. Do not share accounts; each record should show who completed it.
- Your organisation is responsible for who it gives access to, and for removing access when someone leaves.
- Tell us straight away at [email protected] if you think an account has been misused.
4. Your records
- Your organisation owns the training, VOC and corrective action records it creates in the service.
- You give us permission to store and process those records only to provide the service and support you.
- You are responsible for the accuracy of the information entered, and for having a lawful basis to give us personal information about your workers.
- We handle personal information as described in our Privacy Policy.
5. Assessment decisions stay with you
The programs and VOC forms are based on industry practice and publicly available WA standards, adapted for workplace use. Your organisation and its assessors decide whether a person is competent, fit for duty or authorised to drive or operate. Automatic results in the app (for example "Not Yet Competent" when a Critical item is rated P) are a guide based on what the assessor recorded. They do not replace the assessor's judgment, your site procedures, your fatigue management system or any legal requirement.
6. Acceptable use
Do not:
- try to access another organisation's records, or records your role does not allow;
- interfere with, overload or probe the security of the service;
- enter false records, or complete a record for an assessment that did not happen;
- copy, resell or republish the programs and forms outside your organisation without our written agreement.
We may suspend an account that breaches these rules or puts the service or other users at risk.
7. Our content
We own the website, apps, programs, forms, Word and PDF files and their design. During your use of the service your organisation may use, print and adapt them for its own internal training and assessment. Content we build or adapt for your organisation remains ours unless we agree otherwise in writing, and you may keep using it internally as described above while you use the service.
8. Availability
We aim to keep the service available and your records safe, but we cannot promise it will always be uninterrupted or error-free, particularly during the Founding Pilot. Keep the Word or PDF versions available for areas without signal, and export records you need to keep.
9. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Otherwise, to the extent the law allows:
- the service is provided as is, and we are not liable for indirect or consequential loss, lost profits or loss of data;
- we are not responsible for decisions your organisation makes using the service, or for incidents involving people or vehicles assessed with it;
- our total liability for the Founding Pilot is limited to resupplying the service, and for a paid service to the fees paid in the 12 months before the claim.
10. Ending use
Your organisation can stop using the service at any time by telling us. We can end access with 30 days' notice, or straight away for a serious breach of these terms. Sections 4, 7, 9 and 11 continue after use ends.
11. General
These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction. We may update these terms; the date at the top shows the latest version, and we will tell active organisations about significant changes.
